This website, arkaeliteproperties.com, is operated by Arka Elite Properties (“Arka Elite”, “we”, “us” or “our”), with its office at H no. 7-1-643, Block-A, Flat no. 101, Sr Nagar, Bhanu Enclave, ESI, Ameerpet, Hyderabad 500018, Telangana, India.

We market real estate projects, including the Vasavi – White Lotus villa plot project at Balanagar (Shadnagar), developed in association with Vasavi Group. This Privacy Policy explains what personal data we collect when you visit our website, enquire about a property, or deal with us, and how we use and protect it.

We process personal data in accordance with the Digital Personal Data Protection Act, 2023 and the rules made under it, the Information Technology Act, 2000, and other applicable Indian laws. By using this website or submitting your details, you agree to this policy.

2. Information we collect

Information you give us

• Enquiry forms: when you request a brochure, the master layout, or the 360° virtual tour, we collect your name, email address, mobile number and how you heard about us.
• Calls, WhatsApp, email and site visits: any details you share with our team, such as your budget, preferred plot size, and site-visit dates.
• Booking and purchase: if you go ahead with a booking, we collect what is needed to complete the transaction and registration. This may include your PAN, Aadhaar or other ID and address proof, photographs, bank and payment details, and nominee or co-applicant details.

Information collected automatically

• Technical data such as your IP address, browser type, device type, pages viewed and the date and time of your visit.
• Data collected through cookies and similar technologies (see Section 6).

Information from others

• Details passed to us by a friend or existing customer who refers you, by our channel partners, or through lead forms on platforms such as Facebook, Instagram or Google, where you have chosen to share them.

3. How we use your information

We do not sell or rent your personal data to anyone.

4. Consent & communication

When you submit a form on this website, you agree that Arka Elite Properties and its authorised representatives may contact you by phone call, SMS, WhatsApp and email about the project you enquired about. This applies even if your number is registered on the National Customer Preference Register (NCPR/DND), and only for the purpose you enquired about.

You can withdraw your consent or stop marketing messages at any time by:

• replying “STOP” to our WhatsApp or SMS messages,
• telling our representative during a call, or
• emailing support@arkaeliteproperties.com.

Withdrawing consent does not affect anything done before you withdrew it. It also does not apply to messages we must send about an existing booking or legal obligation.

5. Who we share it with

We share your personal data only when necessary, and only with:

• Project developer: Vasavi Group, for bookings, allotment, agreements and project updates relating to the property you are interested in.
• Authorised channel partners and staff who assist with your enquiry or site visit.
• Service providers who help us run our business, such as website hosting, form and email services, CRM software, telephony and WhatsApp messaging. They may use your data only to provide those services to us.
• Banks and housing finance companies, only if you ask us to help with a loan.
• Lawyers, auditors and government authorities, such as the Sub-Registrar office, TG-RERA, tax authorities or the police, where required for registration or by law.
• A successor business, if our business is merged, acquired or restructured. Your data will remain protected under this policy.

6. Cookies & third-party services

Cookies are small files stored in your browser. We use them to keep the website working properly, to remember your preferences and to protect our forms from spam.

Some features on our website are provided by third parties, who may set their own cookies and collect data under their own privacy policies:

• Google reCAPTCHA: protects our forms from spam and bots.
• Google Maps: shows the project and office location.
• YouTube: plays embedded project and CSR videos.
• WhatsApp (Meta): if you choose to chat with us.

7. How long we keep it

• Enquiry data: until you ask us to delete it or withdraw consent, or for up to [2] years after our last contact with you, whichever is earlier.
• Booking and transaction records: for as long as required under tax, property, RERA and other applicable laws, typically up to 8 years after the transaction.

After that, we delete or anonymise your data securely.

8. How we protect it

We use reasonable security measures to protect your data against unauthorised access, loss or misuse. These include encrypted (HTTPS) connections, restricted access for staff, and secure storage. No method of transmission over the internet is completely secure, but we work to protect your information. If a data breach affects you, we will inform you and the authorities as required by law.

9. Your rights

Under the Digital Personal Data Protection Act, 2023, you have the right to:

• Access a summary of the personal data we hold about you and how we use it;
• Correct or update inaccurate or incomplete data;
• Erase your data when it is no longer needed, unless we must keep it by law;
• Withdraw consent at any time;
• Nominate another person to exercise these rights on your behalf in case of death or incapacity; and
• Raise a grievance with our Grievance Officer, and if you are not satisfied, complain to the Data Protection Board of India.

10. Children

Our website and services are meant for adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has shared their details with us, please contact us and we will delete them.

11. Other websites

Our website contains links to other sites, such as Facebook, Instagram, YouTube and Google Maps. We are not responsible for the privacy practices of those websites. Please read their privacy policies.
